Thoughts on vendor policy that issues store credit for items not shipped.

I have a feeling I know the vendor as well. If it is them, they are sadly going down hill very quickly.

With that’s said, I do not think you are thinking unreasonably. If it never ships, should be a refund, period.

If you want to bring policy into the argument, I’d screenshot the policy (before they decide to go and change it) and then state the clam is an invert not a coral therefore the policy can’t apply.

ETA: Just saw your other thread. That’s what I figured.

Op has a gripe with them on the vendor feedback. It is who everyone thinks it is.

Why should I be required to make further purchases? What is to prevent the vendor from saying another piece was not fit to ship so another store credit is issued. I understand doa policy and that things happen. The vendor just failed to ship an item
This has happened to me before also

My newest pet peeve is replacements we’ll ship with your next order. Ah no. Why do I have to buy more crap just to get what I ordered the first time.
this has been a long pet peeve of mine. Often I will see a hard to get item from a vendor I don’t shop often. If I miss it, my shipping charges get “diluted” by less merchandise…basically I’ve added unnecessary cost per item.
Who says I want to comeback, and why should I?

I will say a doa is different than a not in stock / not shipped

DOA - you paid for the coral and for it to be shipped. Dealer offers credit for a future sale because they no longer have the coral, the money for the coral, and had to pay employees to pack it, materials for shipping etc. often the shipping is more than what we pay and the vendor eats it. They held their side of the deal and you were shipped a coral. What happens after it leaves their hands is out of their control as long as it’s packed well.
good point and it only adds to the dilemma, but also mind you they have “some” control over shipping: adding heat packs or not, leaky bags, et et …
Why should I repay shipping charges for poorly packaged goods?

OP not to ramble but I feel you dilemma

Your Rights When You Shop by Mail, Online, or by Phone

The federal Mail, Internet, or Telephone Order Merchandise Rule applies to most things you order by mail, online, or by phone. It says:

  • Sellers have to ship your order within the time they (or their ads) say. That goes whether they say “2-Day Shipping” or “In Stock & Ships Today.” If they don’t give a time, they must ship within 30 days of when you placed your order.
  • If there’s a delay shipping your order, the seller has to tell you and give you the choice of either agreeing to the delay or canceling your order for a full refund.
  • If the seller doesn’t ship your order, it has to give you a full refund — not just a gift card or store credit.

You'd think sellers would grasp the laws and regulations vs trying to take advantage of buyers.

Did you contact them and ask for a refund instead?

A lot of times venders will make things right if you ask regardless what the policy says.
I am waiting to hear back from them. If I do not hear anything by Friday I will be starting a dispute with my CC company.

$80 crocea gone in less than 24 hours. It was gaping when placed in my tank but they saw fit to ship that one. Funny how the most expensive one, a nice green maxima was the one not fit to ship
Must be policy to not ship the most expensive item on the order and try to keep the money :thinking-face: Spin a negative to a positive. At least my peppermint took care of the aiptasia.

I'm starting a dispute this afternoon if I don't hear from the vendor today. Enough is enough

This is a maxima that I got from PEA 15 months ago at 2 inches. It's about 4-5 inches now.

I likely don’t need to say this but be sure to indicate to the CC that you are going to incur additional losses ie a day off work without pay, absenteeism that effects merit raise as this is a live animal that will require immediate care etc, and that the vendors live guarantee will be voided if you are unable to inspect the animal within 2 hours of delivery further necessitating you missing work. Term the item as a live animal that requires specific light and temperature parameters to survive. CC rep likely will not understand the care requirements of a clam. Because their policy (if it’s who I think it is) is replace or credit and a lazy rep will stop there.
They agreed to provide the item at time of purchase. That they have no policy for an unavailable healthy animal in print for you to view SHOULD be considered separate from the dead on arrival policy available to the public. Cover all your bases in initial complaint anticipating arguments from the vendor.

The plate coral was an incredible specimen and I have been watching the website for fragments but I have not seen any. I suspect that one of the crew took it home with them or it died and the skeleton was all that they had left?

I got nothing for $200.00 except a promise for credit and a cluster response. I have learned to leave the $$ on the table and watch the business sink from the sickness that ensues. Here we are, tell me how I am wrong based upon the thread here?

And how come posters kept reporting that they had a suspect and when the other thread is started it confirms everything, including my investment strategy.

Hmmm, “gaping clams” ? and within 24 hrs? …I’ve seen that before :rolleyes:

gheez, I wonder if this is actually a “continuation thread” that’s outside of the silo….
Not my thread, maybe not my place but talking around this and avoiding names; to avoid being info silo. …feels weird …

i just read all this with a sinking heart... i placed my first order with this same vendor not long ago and it has been a very dismal thing ever since i got it. out of all the stuff i ordered, only 2 of the corals are still alive and looking ok. i guess i shouldve just counted some of them doa but they told me to just give them time and see if they revived. what a joke. of course they didnt. but i really wanted to give them the benefit of the doubt. never ever again!!!

Just an update. The vendor has agreed to refund the price of the clam not shipped. They totally ignored the fact that the crocea arrived gaping and died in less than 24hrs and the derasa appears to have PMD. I expected as much but feel a more reputable vendor may have at least apologized.
I've been thinking this whole mess over and have come to the conclusion that the vendor put me on the defensive with the very first email they sent telling me there was a problem with the one clam. The bold text below was in the body of the first email and the second one sent 3 minutes later as well. I feel like they were trying to let me know they had no intention of refunding the money for the clam not shipped. Had they just told me about the clam and not rubbed their policy in my face like they were telling me they were not going to issue a refund before we even discussed the issue I probably would not have made this post. Poor business practice IMO. But I'm glad I did post so others can be made aware of their business practice. I'll refrain from naming them so this post does not get removed but I think most of you have already figured out who the vendor is. I'll update the vendor feedback once I have received the refund.

Just an update.
I was recently contacted by the vendor and offered replacments for the two clams that did not survive free of charge when they receive a new supply. I will update this thread when they are received. I am currently awaiting the refund on the clam not shipped to post to my account but I have received an email stating it has been issued so I think that part has been handled.
