Thoughts on vendor policy that issues store credit for items not shipped.

Back ground. I placed an order for 3 clams. The evening before shipping at 7:20pm I received an email stating one of the clams did not look good. At 7:23pm I received an email stating a replacement may be available. At 8:19pm I received an email stating the items have shipped. I received no phone calls prior to shipping even though the vendor states they called. I did not see the emails until later in the evening. I received two of the three clams I purchased. The vendor policy states if a coral is not shipped because of heath issues a store credit will be issued. First off I did not purchase coral I purchased clams so does the policy even apply? If a vendor fails to fulfil an order should I not receive a refund for that item that I did not receive? Why should I be required to make further purchases? What is to prevent the vendor from saying another piece was not fit to ship so another store credit is issued. I understand doa policy and that things happen. The vendor just failed to ship an item. I'm venting but also looking for opinions. Am I being unreasonable requesting a refund for the item not shipped? I am not asking for any shipping credit simply a refund of the purchase price for the item not shipped. TIA

I take a harder line on this than a lot of ppl. My newest pet peeve is replacements we’ll ship with your next order. Ah no. Why do I have to buy more crap just to get what I ordered the first time.

I had a vendor fail to ship half the CUC I ordered because they were “out” when they went to fill the order. They said they would ship when back in stock. They wanted me to pay $50 again for overnight. No. Not happening. Just cancel and refund that portion of the order. Not their policy they said. I said “behold the power of AMEX.” And as they should have, AMEX did the charge back for that part of the order because I would have had to incur additional charges they felt were excessive.
I’ve had ppl on this forum tell me you can’t get CC companies to charge back and yadah yadah. I have literally never had a CC refuse a charge back request.

I bought coral on eBay everything arrived dead. I asked for a refund they said replacement I said okay. They wanted shipping costs. I said no. Visa did a charge back for the same reason AMEX did “additional charges above a reasonable amount”. I will clarify that neither reimbursement from the CC included the original shipping charge as shipping is pretty universally understood to be non refundable.

I don't think you can policy your way out of the right to redress.

Maybe you can, but that would defeat the purpose considering the strategies that can be taken to force a customer to accept terms without actually taking the time to look at the terms. Just my thought.

EDIT: just as I sent this I realized how silly I am for thinking that, my wife uses instore pickup at walmart and they consistently substitute smaller quantity packages for things at the same charge.

This isn't even just food items, we got a pack of roku plugs that were the same price as the individual, expected 12 total for auto feeders, and received 3 singles instead. Walmart refused to exchange or refund because they were the same price. Stores get away with things like this all the time I suppose, so maybe having it in the policy is enough... that sucks
You have a right to refuse substitutions at time of pickup.

Mine brings it out and goes over the subs and we can accept or reject

It's during check out. We ussualy do not allow. Easier for us.

Your Rights When You Shop by Mail, Online, or by Phone

The federal Mail, Internet, or Telephone Order Merchandise Rule applies to most things you order by mail, online, or by phone. It says:

  • Sellers have to ship your order within the time they (or their ads) say. That goes whether they say “2-Day Shipping” or “In Stock & Ships Today.” If they don’t give a time, they must ship within 30 days of when you placed your order.
  • If there’s a delay shipping your order, the seller has to tell you and give you the choice of either agreeing to the delay or canceling your order for a full refund.
  • If the seller doesn’t ship your order, it has to give you a full refund — not just a gift card or store credit.

This was a very useful post.

I ordered a coral from a seller online and they called and told me that one of the corals had gone missing or died and offered me a credit that I have not received. I wasn’t eager for the money or a credit, I wanted the coral and was/am bummed that it wasn’t sent to me.

I think I will visit with them and see what happens. Thanks for the info.

I will say a doa is different than a not in stock / not shipped

DOA - you paid for the coral and for it to be shipped. Dealer offers credit for a future sale because they no longer have the coral, the money for the coral, and had to pay employees to pack it, materials for shipping etc. often the shipping is more than what we pay and the vendor eats it. They held their side of the deal and you were shipped a coral. What happens after it leaves their hands is out of their control as long as it’s packed well.

Not shipped = refund. They put no time or effort into shipping it. You bought a product that no longer exists. They can’t hold their side of the deal. That’s a refund my friend

IMO, it is a way for a vendor to keep making money. We pay them with cash (or credit), they get the payment and we get what? Another shipping bill where we have to also spend more money to get our original coral.

Let's take this a step further, how many times do you get coral that looks absolutely nothing like the picture advertised? Would you want store credit to buy from them again or a refund? You would have to pay return shipping for a refund..? When does it end? When the customer says no more and is out of their money?

I've only had good experiences with online vendors, this go around

I have nothing to kvetsch about. Even my Saltwateraquarium.com slacker snails all started to move

This exactly my thought. I've been buying and selling online since shortly after ebay was started. I've never in my life heard of a seller keeping money for an item they could not provide.
Whats next? We purchase one piece plus shipping, they say the piece isn't fit to ship so they are keeping all of your money as a store credit. But they'll be kind and not charge shipping on your next item. Then they fold and walk away with the store credits they accumulated. I think not, at least not unless it is allowed by us the consumer.

Ship when we get it in stock isn’t a viable option with live animals. I’ve had to take a second day off work for late/early shipments. Most of us schedule our shipping days around when we will be home. I have had vendors not notify me of shipment changes until the last minute and one not notify me at all and got notified of the delivery through UPS. Guarantees are voided when the box sits on your porch for 6 hours.

We can’t provide the item issues should be a refund. My fave vendor on EBay: hey that colony wasn’t looking great. We REFUNDED your purchase on that and sent you a two polyp frag free. So sorry!” That’s how it should be handled.

Did you contact them and ask for a refund instead?

A lot of times venders will make things right if you ask regardless what the policy says.
